§ 17-10. Industrial areas.

  • (A)

    Resolutions [and ordinances] creating the various industrial areas were enacted in [substantially] the following form; the identification of each such area is included herein as subsection (B):

    "(a)

    The land, an accurate legal description of which is attached to the resolution [or ordinance] from which this section is derived as Exhibit "A" and an accurate legal map of which is attached thereto as Exhibit "B" be, and it is hereby designated and established as an industrial area under the terms and conditions of, and with all the privileges and immunities granted under Louisiana Revised Statutes, section 33:130.11 et seq.

    "(b)

    The secretary of the police jury is instructed to file certified copies of the legal description, the map of the industrial area, and the resolution from which this section is derived with such instruments attached, with the clerk of the district court of the parish in both the mortgage and conveyance records of said parish.

    "(c)

    The secretary of the police jury is further directed to furnish a certified copy of such resolution to petitioner, and to the assessor of the parish, and to request that the assessor duly note the action of this police jury in the records of such assessor's office.

    "(d)

    The secretary of the police jury is further instructed to provide a certified copy of such resolution to the State Department of Commerce and Industry, Baton Rouge, Louisiana, and to the State Department of Public Works, Baton Rouge, Louisiana, and to any other public agency as such secretary may deem fit in order to carry out the purpose and intent of such resolution.

    "(e)

    Industry located within the boundaries of the industrial area hereby designated and established as described in Exhibits "A" and "B" shall be exempt from any new tax levied by a special service district for the purpose of providing water service after said industry located within the industrial areas has filed an affidavit with the secretary of the police jury stating that it is privately furnishing and maintaining within its own premises within the industrial area its own water service.

    "(f)

    Any industry located within the boundaries of this industrial area as described in Exhibits "A" and "B" shall be exempt from any new tax levied by a special service district for the purpose of construction and cleaning of non-public streets after said industry located within the industrial area has filed an affidavit with the secretary of the police jury stating that it is privately furnishing and maintaining within its own premises within the industrial area its individual construction and cleaning of non-public streets therein.

    "(g)

    Any industry located within the boundaries of this industrial area as described in Exhibits "A" and "B" hereto shall be exempt from any new tax levied by a special service district for the purpose of street lighting after said industry located within the industrial area has filed an affidavit with the secretary of the police jury stating that it is privately furnishing and maintaining within its own premises within the industrial area its individual street lighting.

    "(h)

    Any industry located within the boundaries of this industrial area as described in Exhibits "A" and "B" shall be exempt from any new tax levied by a special service district for the purpose of providing sewers and sewerage works after any industry located within the industrial area has filed an affidavit with the secretary of the police jury stating that it is privately furnishing and maintaining within its own premises within the industrial area its individual sewers and sewerage works.

    "(i)

    Any industry located within the boundaries of this industrial area as described in Exhibits "A" and "B" shall be exempt from any new tax levied by a special service district for the purpose of providing fire protection after any industry located within the industrial area has filed an affidavit with the secretary of the police jury stating that it is privately furnishing and maintaining within its own premises within the industrial area its individual fire protection.

    "(j)

    Any industry located within the boundaries of this industrial area as described in Exhibits "A" and "B" shall be exempt from any new tax levied by a special service district for the purpose of providing garbage and refuse collection and disposal after any industry located within the industrial area has filed an affidavit with the secretary of the police jury stating that it is privately furnishing and maintaining within its own premises within the industrial area its individual garbage and refuse collection and disposal.

    "(k)

    No industry located within the boundaries of this industrial area shall have any of the privileges and immunities set forth in Louisiana Revised Statutes, section 33:130.11 et seq. or of such resolution unless and until that industry files with the secretary of the police jury a duly executed agreement that said industry will notify the police jury in writing immediately upon the discontinuance of the furnishing or maintenance of any one or all of the services hereinabove enumerated to themselves and that industry will further allow an inspection by the police jury or any agent or designee thereof of the premises on which the industry is claimed, by affidavit duly filed, that they are furnishing and maintaining any or all of the above enumerated services. Such inspections shall be limited to observations of the areas and facilities pertinent to the services which the industries claim by duly filed affidavit to be furnishing themselves.

    "(l)

    The secretary of the police jury is further authorized and directed to file certified copies of all of the agreements filed with the secretary by industries located in the industrial area, complying with the requirements of such resolution, with the assessor of the parish.

    "(m)

    This section shall not, in any way, impair or restrict any agreement between industry located in this industrial area and the police jury and/or the City of Donaldsonville from mutual police and fire protection in the event of grave emergencies involving the public safety and requiring mutual aid and assistance in protecting same."

    (B)

    Following are the land descriptions of the various industrial areas and the owners thereof:

    (1)

    Property of Wyandotte Chemicals Corporation included in an Industrial Area created in accordance with the provisions of L.R.S. 33:130.11 et seq., said property being more particularly described as follows: A certain tract or parcel of land, situated on the East bank of the Mississippi River, being formerly Cottage Farm Plantation, and a part of Mount Houmas and Linwood Plantations, composed of portions of Sections 11, 13 and 14, Township 10 South, Range 2 East, Parish of Ascension, State of Louisiana, containing 1645.4 acres, more or less, and being more particularly described according to the landowner's survey drawing No. G-3187 hereto attached as follows: Beginning at the point of intersection of the center line of the Levee and the Northeasterly property line of Wyandotte Chemicals Corporation; thence N 42° 59' E 2626.5 feet; thence S 57° 39' E 1300 feet; thence N 55° 44' E 749.54 feet; thence N 57° 39' W 755.25 feet; thence N 55° 44' E 5566.3 feet; thence N 47° 06' 30" W 1929.10 feet; thence N 42° 59' E 100.0 feet; thence S 47° 06' 30" E 1145.2 feet; thence S 46° 26' E 2117.8 feet; thence N 54° 15' E 3428.8 feet; thence S 46° 38′ E 1886.4 feet; thence S 54° 33′ E 629.3 feet; thence S 45° 42' E 2118.7 feet; thence S 56° 02' W 10,303.59 feet; thence S 55° 27' 20" W 3651.24 feet; thence N 35° 05' W 2040.17 feet; thence N 35° 09' 10" W 3067.9 feet; thence N 41° 18' W 235.7 feet; thence N 7° 02' 50" W 277.5 feet to the point of beginning.     A certain tract or parcel of land owned by First Mississippi Corporation et al., together with all buildings and improvements thereon, and all rights, ways, accretions, privileges, servitudes, prescriptions and advantages belonging or in anywise appertaining thereto, situated on the right descending or West bank of the Mississippi River, being formerly a part of Riverside and Stella Plantations, composed of portions of Sections 10, 11, 33, 40 and 71, Township 11 South, Range 15 East, Parish of Ascension, State of Louisiana, containing 1,000 acres, more or less, and being more particularly described according to a plat of survey dated March 12, 1965, as follows: Commence at the Northwest corner of Section 33, Township 11 South, Range 15 East, said corner being the common corner for Sections 33 and 32, Township 11 South, Range 15 East (marked by Old Stone (Granite)); thence proceed South 1° 02' 48" East along Western line of Section 33 (the dividing line between Sections 32 and 33), a distance of 306.55 feet to a point on the northern right of way line of the Texas & Pacific Railroad; thence South 48° 30' 30" East along Northern right of way line of said railroad a distance of 1266.30 feet to the point of beginning (being the Southwest corner of the property herein conveyed); thence North 1° 00' 00" West a distance of 7388.61 feet to a point and corner; thence South 86° 28' 00" West a distance of 53.05 feet to a point and corner; thence North 2° 32' 24" East a distance of 1082.61 feet to a point and corner; thence North 36° 33' 46" West a distance of 46.25 feet to a point on Southern line of Louisiana Highway 18; thence North 15° 21' 16" West across Louisiana Highway 18 and levee a distance of 241.33 feet to a point; thence South 58° 00' 46" West a distance of 206.01 feet and point, thence North 86° 55' 03" West a distance of 622.72 feet to a point, thence North 1° 02' 48" West a distance of 290.73 feet, more or less, to the mean low water line of the Mississippi River and corner; thence in an Easterly direction meandering along the mean low water line of the Mississippi River a distance of 3189.79 feet, more or less, to a point and corner; thence South 27° 02' 47" East a distance of 729.85 feet, more or less, to a concrete monument on the Southern line of Louisiana Highway 18; thence continuing South 27° 02' 47" East a distance of 1418.55 feet to a point and corner; thence North 62° 38' 00" East a distance of 548.53 feet to a point and corner; thence South 33° 31' 11" East a distance of 5522.82 feet to a point and corner; thence North 70° 24' 05" East a distance of 40.01 feet to a point and corner; thence South 64° 57' 16" East a distance of 169.30 feet to a point and corner, thence proceed along the arc of a curve to the left (the radius of which curve is 150.00 feet and the long chord of which bears North 69° 26' 53" East, 214.33 feet) a distance of 238.75 feet to a point and corner; thence North 23° 51' 03" East a distance of 293.12 feet to a point on the Parish line common to Ascension Parish and St. James Parish and corner; thence South 18° 48' 17" East along said parish line a distance of 949.59 feet to a point and corner; thence continuing South 52° 23' 00" West along said parish line a distance of 1818.87 feet to a point and corner; thence South 74° 48' 26" West a distance of 6152.54 feet to the point of beginning.     (3)

    A certain tract of land situated in the Parish of Ascension, State of Louisiana, on the left or East bank of the Mississippi River in Section 9, Township 10 South, Range 3 East, Southeastern District of Louisiana, together with all the rights, ways, privileges, servitudes and batture thereon and thereunto belonging, bounded in front by the low water mark of the Mississippi River, above by lands owned by Ormet Corporation and by Olin Mathieson Chemical Corporation, formerly Conway and Clark Plantations, below by Monroe and Bursle Plantations and in the rear by the eighty (80) arpent line and the remainder of Orange Grove Plantation, being a portion of the tract of land known as the Orange Grove Plantation, and being a part of the whole tract acquired by Miles Planting & Manufacturing Co. by an act passed before James S. Barman, Notary Public, for the Parish of Ascension, dated May 4, 1904, recorded in the conveyance records of Ascension Parish in Book 45, page 533, and being the same, and all of the property acquired by present vendor as per acts of record in the Conveyance Records of Ascension Parish in Book 134, Page 109. The above described property is subject to outstanding rights-of-way for pipe lines, power lines, railroads, drainage canals and public roads. The tract of land herein described contains one thousand (1,000) acres more or less plus 20.03 acres in levee, the Jefferson Highway right-of-way and the Sorrento-Darrow Highway as more particularly described according to a survey made by Durald F.     A certain tract or parcel of land, together with all rights, ways, privileges, appurtenances and batture thereunto belonging, situated in Sections 13, 14, 15, 16, 17 and 18, Township 10 South, Range 2 East, Southeastern District of Louisiana, in the Parish of Ascension, Louisiana, the property herein conveyed being more particularly described as follows: Begin at the intersection of Sections 1, 13, and 80, said Township 10 South, Range 2 East, Southern District of Louisiana (said point of intersection being marked by an old ¾ inch iron pipe);
